These Terms of Service govern your access to and use of Mixany. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Mixany.
Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If the law where you live requires parental or guardian consent, you may use Mixany only with that consent.
You are responsible for providing accurate account information, protecting your credentials, and for activity under your account. Notify us promptly if you believe your account has been compromised. You may not sell, transfer, or misuse access to an account.
The service
Mixany is intended to provide task-focused AI tools for creating and editing content. Features, models, limits, availability, and output quality may change. We may add, modify, suspend, or discontinue features when reasonably necessary to develop, secure, or operate the service.
Plans, credits, and payments
The product, price, currency, billing interval, included credits, and any renewal terms shown on the pricing or checkout page at the time of purchase form part of your order. Taxes may be added where required.
Payments are processed by a third-party checkout provider and Merchant of Record, which acts as the legal seller for the transaction and handles payment processing, applicable transaction taxes, receipts, billing disputes, and payment-related refunds. Its buyer terms and privacy policy may also apply.
Subscriptions renew automatically at the interval and price disclosed at checkout until cancelled. You may cancel before the next renewal through the available billing or customer portal. Unless otherwise required by law or stated in our Refund Policy, cancellation takes effect at the end of the current paid period and does not retroactively refund that period.
Credits are digital service units used to access eligible Mixany features. They are not money, are not transferable, cannot be resold or redeemed for cash, and may expire as disclosed at purchase or grant. Promotional credits may have different conditions from purchased credits.
Delivery and access
Paid credits or subscription access are delivered electronically to the Mixany account associated with the checkout email after successful payment confirmation. Delivery is normally immediate but may be delayed by payment review, network issues, or service incidents. If a purchase is not reflected in your account, contact support@mixany.ai with the account email and order identifier. We normally respond to product-support requests within two business days.
Your inputs and content
You retain any rights you already hold in prompts, uploads, and other content you submit. You grant Mixany a limited licence to host, copy, transmit, transform, and process that content only as needed to provide, secure, and improve the service, comply with your instructions, and meet legal obligations.
You represent that you have the rights and permissions needed to submit your content and to instruct us to process it. You are responsible for your content and for how you use generated results.
Generated results
Subject to applicable law and third-party provider terms, Mixany does not claim ownership of generated results created for you. AI outputs may be inaccurate, incomplete, unexpected, non-unique, or similar to content produced for others. They may not be suitable for legal, medical, financial, safety-critical, or other high-stakes decisions.
You are responsible for reviewing results and determining whether your intended use is lawful and respects privacy, publicity, copyright, trademark, and other third-party rights. Mixany does not guarantee that an output is available for exclusive or commercial use.
AI models
Mixany uses third-party AI models to provide text- and photo-based generation. We may update or replace models as the service develops, including for quality, safety, availability, or cost reasons.
Acceptable use
You may not use Mixany to:
- Break the law, facilitate wrongdoing, or evade applicable restrictions.
- Create, request, upload, or distribute pornography, explicit sexual content, nudity intended for sexual gratification, sexual services, fetish content, or other pornographic or NSFW material, including non-consensual intimate imagery and AI undressing.
- Create, request, upload, or distribute graphic violence, gore, torture, mutilation, glorification of violent harm, or instructions intended to facilitate serious physical harm.
- Promote hatred, dehumanisation, exclusion, or violence against a person or group based on race, ethnicity, nationality, religion, caste, disability, sex, gender, gender identity, sexual orientation, or another protected characteristic.
- Create, request, upload, or distribute child sexual abuse material, sexualised depictions of minors, grooming content, or any content that exploits, sexualises, abuses, or endangers a child. This applies to real, fictional, illustrated, and AI-generated content.
- Create deceptive deepfakes, impersonate another person, misrepresent a person's identity or actions, or use a person's likeness without the rights and consent required by law, especially for fraud, harassment, sexual content, political deception, or reputational harm.
- Infringe or facilitate infringement of copyright, trademark, privacy, publicity, or other rights, including by uploading material you are not authorised to use or requesting content intended to pass off as another creator or brand.
- Impersonate, defraud, harass, threaten, deceive, or exploit another person.
- Create malware, phishing, credential theft, or instructions intended to cause material harm.
- Probe, disrupt, overload, reverse engineer, or bypass security, access, usage, or payment controls.
- Use automated access at a scale or in a manner we have not authorised.
Reporting prohibited content
Report suspected prohibited content, an abusive account, or an unsafe generated result to support@mixany.ai. Include the relevant product or page, the approximate date and time, the account email or generation identifier if available, and a short explanation of the concern. Do not email, download, or redistribute illegal content merely to make a report. If a child may be in danger or there is an immediate threat of harm, contact the appropriate local authorities or emergency services.
Content moderation and enforcement
Requests and outputs may be evaluated by safety controls made available by the underlying AI providers. Mixany may also use request restrictions, abuse signals, rate limits, user reports, and manual review to identify possible violations. No automated or manual process can identify every violation, and users remain responsible for their inputs and use of results.
When we receive a report or detect a possible violation, we may review the relevant request, output, account activity, and available technical records; restrict or remove content; block a request; preserve information where legally required; limit features; suspend or terminate an account; or report apparent illegal activity to the appropriate authorities. We consider the nature, severity, context, repetition, and legal risk of the conduct. Questions about an enforcement decision may be sent to support@mixany.ai.
Third-party services
Mixany may use third-party services for AI processing, authentication, infrastructure, storage, email, analytics, and payments. Their terms may apply to their services. We are not responsible for third-party services outside our reasonable control.
Feedback
If you provide feedback, you allow us to use it without restriction or compensation. This does not give us ownership of your other content.
Suspension and termination
You may stop using Mixany at any time. We may restrict or terminate access if you breach these Terms, create risk or legal exposure, fail to pay an amount when billing is available, or if access must be limited to protect the service. Where appropriate, we will provide notice or an opportunity to address the issue.
Disclaimers
To the extent permitted by law, Mixany is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, particular outputs, or that results will meet your requirements. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of liability
To the extent permitted by law, Mixany will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from use of the service. Any limitation applies only to the maximum extent allowed by applicable law.
Changes to these Terms
We may update these Terms as Mixany develops. We will post the revised Terms and change the updated date. If changes materially affect your rights, we will provide additional notice where appropriate. Continued use after the effective date of revised Terms means you accept them.
